Article 1: General provisions
These provisions apply to the Thomas Bradley electronic store. Thomas Bradley is a registered trade mark of Intershirt NV with its registered office at B-9620 Zottegem , Wassenhovestraat 1(Belgium),BTW BE 0416.628.658.Thomas Bradley offers its customers the opportunity to make purchases online. The present General Terms and Conditions ("Conditions") apply to all articles in the Thomas Bradley range and to all purchases made by the customer from Thomas Bradley. The customer accepts that these Terms and Conditions, will be the only ones applicable.
Article 2: Price
All prices quoted are always inclusive of VAT and all other taxes which the customer is required to pay. If transport, reservation or administrative costs are charged, this will be stated separately. The price stated refers exclusively to the articles as described word for word. The accompanying photo is for decorative purposes only and may contain elements of articles not included in the price.
Article 3: Offer
All offers are only open to customers residing in the European Union. The articles are intended exclusively for normal private use. Despite the fact that the catalog and webshop/website are composed with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up to date. If you have specific questions about, for example, sizes, color, availability, delivery period or method, we request that you contact our customer service department beforehand (see article 12). Thomas Bradley is only obliged to provide information which is accurate, up to date or complete. Thomas Bradley is not under any circumstances liable for material errors, typographical errors or printing errors. The offer is valid while stocks last and can at any time be amended or withdrawn by Thomas Bradley. Thomas Bradley is entitled - without giving reasons - to refuse orders, to adjust the delivery times, to split deliveries or to attach other conditions to the delivery.
Article 4: Online purchases
The customer has the option of purchasing articles from the Thomas Bradley range online. The purchase is concluded at the moment the client receives a confirmation e-mail from Thomas Bradley. The items will be delivered to the customer's home on the delivery date indicated in the confirmation e-mail. The customer has the choice between the following payment methods:
- by credit card
- by bank card
Article 5: Retention of title
The delivered items remain the exclusive property of Thomas Bradley until complete payment by the customer. However, the risk of loss or damage shall pass to the customer upon delivery. The customer undertakes, if necessary, to draw the attention of third parties to Thomas Bradley's retention of title, for example, to anyone who may come to seize items that have not yet been paid for in full.
Article 6: Penalties for non-payment
Without prejudice to the exercise of any other rights which Thomas Bradley may have, the client shall, in the event of non-payment or late payment, be liable by operation of law and without notice of default to pay interest on the unpaid amount at the rate of 10% per annum. Furthermore, the client shall be liable, ipso jure and without warning, to pay a fixed compensation of 10% of the amount in question, with a minimum of EUR 25 per invoice. Without prejudice to the above, Thomas Bradley. reserves the right to take back items which have not been paid for (in full).
Article 7: Complaints
Any visible damage and/or qualitative deficiency of an article or other shortcoming in the delivery must be reported immediately, under penalty of lapse of any right.
Article 8: Guarantee
A. Legal warranty (only for consumers)
Under the Act of September 1, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each article is subject to the legal warranty from the date of purchase by (if applicable delivery to) the first owner.
Any commercial guarantee does not affect these rights.
B. General
In order to make a claim under the guarantee the customer must be able to present the proof of purchase. For articles purchased online and delivered to the customer's home, the customer must contact the Thomas Bradley customer service department in advance, after which the customer must return the article to Thomas Bradley at his or her own expense. Any defect must be reported within 2 months of its discovery. After that time, any right to repair or replacement becomes null and void. The guarantee (commercial and/or statutory) is never applicable to defects caused by accidents, negligence, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the item, heavy-handed use, poor maintenance. It also does not apply to articles with a shorter life span, or wear items. Defects that become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are not considered to be hidden defects, unless proven otherwise by the customer. The warranty is not transferable.
Article 9: Right of withdrawal
The provisions of this article apply exclusively to customers who purchase items online in their capacity as consumers: The consumer has the right to notify Thomas Bradley that he renounces the purchase, without payment of any penalty and without giving any reason within the 14 days from the day following the delivery of the product. Customers wishing to exercise the right of withdrawal must contact the Thomas Bradley customer service department within 14 days of delivery and return the goods at their own expense within 20 days of delivery to Thomas Bradley, Wassenhovestraat 1, 9620 Zottegem, Belgium. Only items that are in their original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned. Will not be taken back under any circumstances:
- used, soiled, damaged or incomplete articles
- items of which the packaging (or part of it) has been opened
- items that have been custom-made for the customer
- articles that, by their nature, cannot be returned

Thomas Bradley undertakes to use your data exclusively for the performance of the contract concluded by means of your order and to send you information from Thomas Bradley without obligation. If you also wish to receive information by e-mail, please provide us with your e-mail address.
We treat your data as confidential information and will never pass it on, rent or sell it to third parties. At any time you may request, correct, amend or delete your data that we keep in the Thomas Bradley customer list and you may refuse to allow Thomas Bradley to use your data to send you information. It suffices to request this in writing at the address given below: Thomas Bradley. Customers are responsible for keeping their log-in data confidential and for the use of their password. Your password is stored in encrypted form; Thomas Bradley therefore has no access to it. Thomas Bradley strictly observes the Belgian law of December 8, 1992 regarding the protection of privacy in the processing of personal data. Article 11: Invalidity - non-waivers
If any provision of these Conditions is declared invalid, unlawful or void, this shall not in any way affect the validity, legality and applicability of the other provisions.
The failure at any time by Thomas Bradley to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall not affect the validity of such rights.

Article 13: Amendment of the terms and conditions
These terms and conditions are supplemented by other terms and conditions to which reference is expressly made and by the Thomas Bradley general terms and conditions of sale. In the event of inconsistency, the present terms and conditions will prevail. Thomas Bradley may modify these Conditions at any time without further notice. Any purchase made after the amendment will imply acceptance by the customer of these new terms and conditions.
Article 14: Proof
The customer accepts that electronic communications and back-ups may serve as proof.
